Client agrees to pay a $500 non-refundable booking fee after signing this Services Contract. Payment of the non-refundable booking fee reserves the Performer and any necessary event on the day and time listed above. The remaining balance from the table above shall be due 28 days before the date of the event.
This contract may only be cancelled by written notice via email. Cancellation of the event is non-refundable under all circumstances.
The Performer accepts no liability and offers no refund in the event that the function is cancelled, rescheduled, or postponed due to a Force Majeure event, unforeseen circumstance, or any other occurrence that renders the performance impossible. For the purposes of this agreement, a Force Majeure event includes, but is not limited to, fire, thunderstorms, flooding, national or local emergencies, pandemics, acts of terrorism, or any other extreme event or circumstance that makes it illegal, impractical, or unreasonable for the venue or the parties to proceed with the event.
The Client must notify the Performer in writing of any cancellation as soon as possible. If the Client cancels the booking within 30 days of the event date, 50% of the total fee will be payable as compensation for the Performer's loss of income. Special exceptions regarding the refund of payments, including cancellations due to Force Majeure events, may be made under exceptional circumstances and will be evaluated on a case-by-case basis.
In the case of rescheduling the event, no additional costs will incur if the Performer is available on the new date, and the original date of the event is more than 90 days away. If the original date of the event is less than 90 days away, a 20% surcharge of the original booking fee will be added to the booking on the new date to compensate for the Performer's loss of income. If the Performer is unavailable on the new date of the event, the Performer is entitled to the full booking fee amount, and the booking will be cancelled. If the original date of the event is less than 30 days away, then 50% of the total booking fee will be payable.
In the event that the Performer is unable to fulfil the booking due to illness, injury, or an unexpected emergency, the Performer will provide a suitable and equivalent substitute performer to honour the booking. The substitute shall be of comparable skill and professionalism. In the unlikely event that a suitable replacement cannot be secured, the Performer will provide the Client with a full refund.
Client shall be responsible for ensuring that all event attendees treat the Performer and any equipment on-site with respect. In the event that an attendee acts in a manner which the Performer judges to be dangerous, threatening, or inappropriate, the Performer agrees to provide the Client with one opportunity to correct the behaviour. If the problem persists, the Performer may, without warning, cease providing services and vacate the event. If this occurs, the Client will be responsible for full payment of the fees listed in this contract without exception.
No individual may operate or interfere with the Performer's property without the Performer's explicit consent. The Performer reserves the right to invoice the Client for any damages caused to equipment as a result of unauthorised use by the Client or their guests. If the Performer reasonably determines that equipment is at risk, they may immediately revoke its use. This includes, but is not limited to, hazardous guest behavior, unauthorised access to the DJ booth, and mishandling equipment, such as "dropping the mic" after speeches.
During the event, the Performer shall have the right to capture visual and audio content through photography, videography, or other means. The Client acknowledges and agrees that the Performer may use this Content for promotional purposes, including but not limited to posting on social media platforms and the Performer's website. The Client understands that the Content may include images or recordings of guests, venue décor, and other elements of the event. The Performer agrees to use discretion and sensitivity when selecting and sharing Content, with the aim of promoting the event and services in a positive manner. If the Client has any objections to specific types of Content being shared or posted, they must notify the Performer in writing prior to signing this contract.
Client is responsible for providing the Performer with reasonable working accommodations, including a space no smaller than 3m x 2m with a live power source within 15 metres.
The performance area must be stable and secure, and cannot consist of dirt, gravel, or other unstable surfaces. For outdoor events, the Client agrees to provide a facility that adequately shelters the Performer's equipment from direct sunlight, wind, and rain. Should the Client or venue fail to provide sufficient cover or accommodate the Performer's reasonable requests for an alternative indoor setup, and the Performer determines that their equipment is at undue risk, the Performer reserves the right to decline to provide services without obligation for a refund.
The Performer is not liable in any way for any injuries sustained by the Client or attendees. This includes, but is not limited to, slipping on the dance floor or injuring themselves on the Performer's equipment.
Client accepts full responsibility for providing the listed payments to the Performer in accordance with the terms of the services contract. In the event that the Performer incurs legal or attorney's fees in the course of collecting payment, Client agrees to reimburse the Performer for such fees without question.
